ਗੋਆ ਤੇ ਕਬਜ਼ਾ ਜਾਂ ਹਮਲਾ (ਅੰਗ੍ਰੇਜ਼ੀ ਵਿੱਚ: Annexation of Goa), ਉਹ ਪ੍ਰਕਿਰਿਆ ਸੀ ਜਿਸ ਵਿਚ ਗਣਤੰਤਰ ਭਾਰਤ ਨੇ, ਦਸੰਬਰ 1961 ਵਿਚ ਭਾਰਤੀ ਹਥਿਆਰਬੰਦ ਸੈਨਾਵਾਂ ਦੁਆਰਾ ਕੀਤੀ ਗਈ ਹਥਿਆਰਬੰਦ ਕਾਰਵਾਈ ਨਾਲ ਗੋਆ, ਦਮਨ ਅਤੇ ਦਿਉ ਦੇ ਪੁਰਾਣੇ ਪੁਰਤਗਾਲੀ ਭਾਰਤੀ ਇਲਾਕਿਆਂ ਉੱਪਰ ਆਪਣਾ ਕਬਜ਼ਾ ਕਰ ਲਿਆ ਸੀ। ਭਾਰਤ ਵਿਚ, ਇਸ ਕਿਰਿਆ ਨੂੰ "ਗੋਆ ਦੀ ਮੁਕਤੀ" ਕਿਹਾ ਜਾਂਦਾ ਹੈ। ਪੁਰਤਗਾਲ ਵਿਚ ਇਸ ਨੂੰ “ਗੋਆ ਉੱਪਰ ਹਮਲਾ” ਕਿਹਾ ਜਾਂਦਾ ਹੈ। 1961 ਵਿਚ ਪੁਰਤਗਾਲੀ ਸ਼ਾਸਨ ਦੇ ਖ਼ਤਮ ਹੋਣ ਤੋਂ ਬਾਅਦ ਗੋਆ ਨੂੰ ਫੌਜੀ ਪ੍ਰਸ਼ਾਸਨ ਅਧੀਨ ਕਨ੍ਹਿਮਰਨ ਪਲਟ ਕੈਂਡਥ ਦੀ ਅਗਵਾਈ ਵਿਚ ਉਪ ਰਾਜਪਾਲ ਬਣਾਇਆ ਗਿਆ ਸੀ।[1] 8 ਜੂਨ 1962 ਨੂੰ, ਫੌਜੀ ਸ਼ਾਸਨ ਦੀ ਥਾਂ ਸਿਵਲੀਅਨ ਸਰਕਾਰ ਨੇ ਲੈ ਲਈ ਜਦੋਂ ਉਪ ਰਾਜਪਾਲ ਨੇ 29 ਨਾਮਜ਼ਦ ਮੈਂਬਰਾਂ ਦੀ ਇੱਕ ਗੈਰ ਰਸਮੀ ਸਲਾਹਕਾਰ ਕੌਂਸਲ ਨੂੰ ਇਸ ਖੇਤਰ ਦੇ ਪ੍ਰਬੰਧ ਵਿੱਚ ਸਹਾਇਤਾ ਲਈ ਨਾਮਜ਼ਦ ਕੀਤਾ।[2]

ਭਾਰਤੀ ਆਰਮਡ ਫੋਰਸਿਜ਼ ਦੁਆਰਾ ਕੀਤੀ "ਹਥਿਆਰਬੰਦ ਕਾਰਵਾਈ" ਦਾ ਕੋਡ ਨਾਮ "ਓਪਰੇਸ਼ਨ ਵਿਜੇ" (ਭਾਵ "ਜਿੱਤ") ਸੀ। ਇਸ ਵਿਚ 36 ਘੰਟਿਆਂ ਤੋਂ ਵੱਧ ਸਮੇਂ ਲਈ ਹਵਾਈ, ਸਮੁੰਦਰੀ ਅਤੇ ਜ਼ਮੀਨੀ ਹਮਲੇ ਸ਼ਾਮਲ ਸਨ, ਅਤੇ ਇਹ ਭਾਰਤ ਲਈ ਇਕ ਫੈਸਲਾਕੁੰਨ ਜਿੱਤ ਸੀ, ਜਿਸ ਵਿਚ ਪੁਰਤਗਾਲ ਦੁਆਰਾ ਭਾਰਤ ਵਿਚ ਬਾਕੀ ਬਚੀਆਂ ਹੋਈਆਂ ਜਗਾਵਾਂ ਉੱਪਰ 451 ਸਾਲਾਂ ਦਾ ਰਾਜ ਖ਼ਤਮ ਹੋਇਆ। ਇਹ ਗਤੀਵਿਧੀ ਦੋ ਦਿਨ ਚੱਲੀ, ਅਤੇ ਲੜਾਈ ਵਿਚ 22 ਭਾਰਤੀ ਅਤੇ 30 ਪੁਰਤਗਾਲੀ ਮਾਰੇ ਗਏ। ਸੰਖੇਪ ਟਕਰਾਅ ਨੇ ਵਿਸ਼ਵਵਿਆਪੀ ਪ੍ਰਸੰਸਾ ਅਤੇ ਨਿੰਦਾ ਦਾ ਮਿਸ਼ਰਨ ਕੱਢਿਆ। ਭਾਰਤ ਵਿਚ, ਇਸ ਕਾਰਵਾਈ ਨੂੰ ਇਤਿਹਾਸਕ ਤੌਰ 'ਤੇ ਭਾਰਤੀ ਖੇਤਰ ਦੀ ਮੁਕਤੀ ਦੇ ਰੂਪ ਵਿਚ ਦੇਖਿਆ ਗਿਆ, ਜਦੋਂਕਿ ਪੁਰਤਗਾਲ ਨੇ ਇਸ ਨੂੰ ਆਪਣੀ ਰਾਸ਼ਟਰੀ ਧਰਤੀ ਅਤੇ ਨਾਗਰਿਕਾਂ ਦੇ ਵਿਰੁੱਧ ਇਕ ਹਮਲੇ ਵਜੋਂ ਵੇਖਿਆ।

ਕਾਨੂੰਨ ਨੀਤੀ[ਸੋਧੋ]

ਸੰਨ 1947 ਵਿਚ ਆਜ਼ਾਦੀ ਤੋਂ ਬਾਅਦ ਭਾਰਤ ਨੇ ਗੋਆ ਉੱਤੇ ਪੁਰਤਗਾਲੀ ਹਕੂਮਤ ਨੂੰ ਮਾਨਤਾ ਦਿੱਤੀ ਸੀ। ਗੋਆ ਉੱਤੇ ਹਮਲਾ ਕਰਨ ਤੋਂ ਬਾਅਦ ਭਾਰਤ ਦਾ ਕੇਸ ਬਸਤੀਵਾਦੀ ਪ੍ਰਾਪਤੀਆਂ ਦੀ ਗੈਰਕਾਨੂੰਨੀਤਾ ਦੇ ਦੁਆਲੇ ਬਣਾਇਆ ਗਿਆ ਸੀ। ਇਹ ਦਲੀਲ ਵੀਹਵੀਂ ਸਦੀ ਦੇ ਕਾਨੂੰਨੀ ਨਿਯਮਾਂ ਅਨੁਸਾਰ ਸਹੀ ਸੀ, ਪਰ ਸੋਲ੍ਹਵੀਂ ਸਦੀ ਦੇ ਅੰਤਰਰਾਸ਼ਟਰੀ ਕਾਨੂੰਨ ਦੇ ਮਾਪਦੰਡਾਂ 'ਤੇ ਸਹੀ ਨਹੀਂ ਪਈ। ਭਾਰਤ ਨੇ ਬਹੁਤ ਸਾਰੇ ਅੰਤਰਰਾਸ਼ਟਰੀ ਭਾਈਚਾਰੇ ਤੋਂ ਹਮਦਰਦੀ ਪ੍ਰਾਪਤ ਕੀਤੀ, ਪਰੰਤੂ ਇਸ ਨਾਲ ਹਮਲੇ ਲਈ ਕਿਸੇ ਕਾਨੂੰਨੀ ਸਹਾਇਤਾ ਦਾ ਸੰਕੇਤ ਨਹੀਂ ਹੋਇਆ।[3] ਭਾਰਤੀ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਅਲਾਟਮੈਂਟ ਦੀ ਵੈਧਤਾ ਨੂੰ ਪਛਾਣ ਲਿਆ ਅਤੇ ਕਿੱਤੇ ਦੇ ਕਾਨੂੰਨ ਦੀ ਨਿਰੰਤਰ ਲਾਗੂਯੋਗਤਾ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ। ਪਿਛੋਕੜ ਵਾਲੇ ਪ੍ਰਭਾਵ ਨਾਲ ਸੰਧੀ ਵਿਚ, ਪੁਰਤਗਾਲ ਨੇ 1974 ਵਿਚ ਭਾਰਤੀ ਹਕੂਮਤ ਨੂੰ ਮਾਨਤਾ ਦਿੱਤੀ।[4] ਇਸ ਕਬਜ਼ੇ ਨੂੰ ਗੈਰ ਕਾਨੂੰਨੀ ਮੰਨਿਆ ਜਾਂਦਾ ਹੈ, ਕਿਉਂਕਿ ਇਹ ਸੰਯੁਕਤ ਰਾਸ਼ਟਰ ਦੇ ਚਾਰਟਰ ਦੇ ਲਾਗੂ ਹੋਣ ਤੋਂ ਬਾਅਦ ਹੋਇਆ ਹੈ। ਬਾਅਦ ਵਾਲੀ ਸੰਧੀ ਇਸ ਨੂੰ ਸਹੀ ਨਹੀਂ ਠਹਿਰਾ ਸਕਦੀ।[5] ਸ਼ੈਰਨ ਕੋਰਮੈਨ ਦਾ ਤਰਕ ਹੈ ਕਿ ਸਵੈ-ਨਿਰਣਾ ਦਾ ਸਿਧਾਂਤ ਨਵੀਂ ਹਕੀਕਤ ਨੂੰ ਅਨੁਕੂਲ ਕਰਨ ਦੇ ਨਿਯਮ ਨੂੰ ਮੋੜ ਸਕਦਾ ਹੈ, ਪਰ ਇਹ ਅਸਲ ਕਬਜ਼ੇ ਦੇ ਗੈਰ ਕਾਨੂੰਨੀ ਪਹਿਲੂ ਨੂੰ ਨਹੀਂ ਬਦਲ ਸਕੇਗਾ।[6]

ਸਭਿਆਚਾਰਕ ਚਿਤਰਣ[ਸੋਧੋ]

ਫਿਲਮ "ਸਾਤ ਹਿੰਦੋਸਤਾਨੀ" (1969), ਆਪ੍ਰੇਸ਼ਨ ਵਿਜੇ ਬਾਰੇ ਸੀ। ਇਸਨੇ ਨੈਸ਼ਨਲ ਏਕਤਾ 'ਤੇ ਸਰਬੋਤਮ ਫੀਚਰ ਫਿਲਮ ਦਾ 1970 ਨਾਰਗਿਸ ਦੱਤ ਅਵਾਰਡ ਜਿੱਤਿਆ, ਅਤੇ ਕੈਫੀ ਆਜ਼ਮੀ ਲਈ ਰਾਸ਼ਟਰੀ ਏਕੀਕਰਣ ਪੁਰਸਕਾਰ ਤੇ ਸਰਬੋਤਮ ਫਿਲਮ ਸੰਗੀਤ ਦੇ ਬੋਲ-ਲੇਖਕ ਪੁਰਸਕਾਰ ਜਿਤਿਆ। "ਤ੍ਰਿਕਾਲ", ਸ਼ਿਆਮ ਬੇਨੇਗਲ ਅਤੇ ਪੁਕਾਰ ਦੀ ਇਕ ਫਿਲਮ ਵਿਚ 1960 ਦੇ ਗੋਆ ਦੇ ਪਿਛੋਕੜ 'ਤੇ ਆਧਾਰਿਤ ਕਹਾਣੀਆਂ ਵੀ ਹਨ।

The conclusion that India's successful annexation of Goa cannot be taken to indicate the existence of a legal right of reconquest in cases where a former colony seeks to recover what it considers to be its pre-colonial frontiers is reinforced-even more strongly and conclusively-by the practice of states in connection with Argentina's attempted conquest or reconquest of the Faulkland islands.
