ਜੈ ਮਾਲਾ ਇੱਕ ਭਾਰਤੀ ਪੱਤਰਕਾਰ, ਸਿਆਸਤਦਾਨ, ਵਕੀਲ ਅਤੇ ਸਮਾਜਿਕ ਕਾਰਕੁੰਨ ਹੈ।[1] ਉਹ ਨੈਸ਼ਨਲ ਹੇਰਾਲਡ ਲਈ ਇੱਕ ਮਹੱਤਵਪੂਰਨ ਸੰਪਾਦਕ ਹੈ,[2] ਇੱਕ ਅਖ਼ਬਾਰ ਜੋ ਭਾਰਤ ਦੇ ਪਹਿਲੇ ਪ੍ਰਧਾਨ ਮੰਤਰੀ ਦੁਆਰਾ ਸਥਾਪਤ ਕੀਤਾ ਗਿਆ। ਉਹ ਜੰਮੂ ਅਤੇ ਕਸ਼ਮੀਰ ਨੈਸ਼ਨਲ ਪੈਂਥਰਜ਼ ਪਾਰਟੀ ਦੀ ਸਹਿ-ਸੰਸਥਾਪਕ ਸੀ[3] ਜਿਸ ਤੋਂ ਪਹਿਲਾਂ ਉਹ ਭਾਰਤੀ ਵਿਦਿਆਰਥੀ ਕਾਂਗਰਸ ਦੀ ਪ੍ਰਧਾਨ ਸੀ।[4] ਜੈ ਮਾਲਾ ਭਾਰਤ ਦੀ ਸੁਪਰੀਮ ਕੋਰਟ ਦੀ ਸੀਨੀਅਰ ਵਕੀਲ ਹੈ।[5][6]

ਉਹ ਇੱਕ ਗੌਡ ਸਰਸਵਤ ਬ੍ਰਾਹਮਣ ਪਰਿਵਾਰ ਵਿੱਚ ਪੈਦਾ ਹੋਈ ਸੀ।[7][8]

ਇੰਡੀਆ-ਗੇਟ ਵਿਖੇ 1979 ਦੇ ਵਿਦਿਆਰਥੀ ਪ੍ਰਦਰਸ਼ਨ ਦੀ ਗ੍ਰਿਫਤਾਰੀ[ਸੋਧੋ]

1979 ਵਿੱਚ ਇੰਡੀਅਨ ਸਟੂਡੈਂਟ ਕਾਂਗਰਸ ਦੇ ਪ੍ਰਧਾਨ ਵਜੋਂ ਜੈ ਮਾਲਾ ਨੇ ਹਜ਼ਾਰਾਂ ਯੂਨੀਵਰਸਿਟੀ ਵਿਦਿਆਰਥੀਆਂ ਨੂੰ ਇੰਡੀਆ ਗੇਟ, ਨਵੀਂ ਦਿੱਲੀ ਵਿਖੇ ਜਨਤਾ ਪਾਰਟੀ ਦੀ ਸਰਕਾਰ ਦੇ ਵਿਰੋਧ ਵਿੱਚ ਅਗਵਾਈ ਦਿੱਤੀ। ਉਸ ਸਮੇਂ ਵਿਦੇਸ਼-ਮੰਤਰੀ ਅਤੇ ਭਵਿੱਖੀ ਪ੍ਰਧਾਨ-ਮੰਤਰੀ ਅਟਲ ਬਿਹਾਰੀ ਵਾਜਪਾਈ ਨੇ ਨਾਰਾਜ਼ ਭੀੜ ਨੂੰ ਸੰਬੋਧਿਤ ਕਰਨ ਦੀ ਕੋਸ਼ਿਸ਼ ਕੀਤੀ ਪਰ ਉਸ ਦੌਰਾਨ ਪੱਥਰਬਾਜ਼ੀ ਕੀਤੀ ਗਈ। ਉਸ ਦੇ ਸਿਰ ਤੋਂ ਖੂਨ ਵਗਣ ਵੇਲੇ ਜੈ ਮਾਲਾ ਨੇ ਉਸ ਨੂੰ ਸੁਰੱਖਿਅਤ ਰੱਖਿਆ, ਜਿਸ ਕਾਰਨ ਉਹ ਨੇੜਲੀ ਸੰਸਦ ਇਮਾਰਤ ਵਿੱਚ ਭੱਜ ਗਿਆ। ਵਿਰੋਧ ਪ੍ਰਦਰਸ਼ਨ ਤੋਂ ਬਾਅਦ ਵਾਜਪਾਈ ਨੇ ਨਿੱਜੀ ਤੌਰ 'ਤੇ ਪਾਰਲੀਮੈਂਟ ਸਟਰੀਟ ਪੁਲਿਸ ਸਟੇਸ਼ਨ ਤੋਂ ਜੈ ਮਾਲਾ ਦੀ ਰਿਹਾਈ ਕਰਵਾਈ।

1982 ਵਿੱਚ ਉਸ ਨੇ ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਜੰਮੂ ਕਸ਼ਮੀਰ ਦੀ ਸਰਕਾਰ ਵਿਰੁੱਧ ਕੇਸ ਜਿੱਤਿਆ। ਕਾਨੂੰਨੀ ਸਹਾਇਤਾ ਦੇ ਵਕੀਲ ਵਜੋਂ ਕੰਮ ਕਰ ਰਹੇ ਜੈ ਮਾਲਾ ਨੇ ਰਿਆਜ਼ ਅਹਿਮਦ ਨੂੰ ਰਿਹਾਅ ਕਰ ਦਿੱਤਾ, ਇਹ ਸਾਬਤ ਕਰ ਦਿੱਤਾ ਕਿ ਉਹ ਅਜੇ ਵੀ ਨਾਬਾਲਗ ਸੀ ਜਦੋਂ ਉਸ ਨੂੰ ਜੰਮੂ-ਕਸ਼ਮੀਰ ਵਿੱਚ ਝੂਠੇ ਤੌਰ 'ਤੇ ਕੈਦ ਕੀਤਾ ਗਿਆ ਸੀ।[9] ਮੁੱਖ ਜੱਜ ਪੀ ਐਨ. ਭਗਵਤੀ ਨੇ ਨਜ਼ਰਬੰਦੀ ਨੂੰ ਰੱਦ ਕਰਦਿਆਂ ਕਿਹਾ ਕਿ ਕੈਦੀ ਵਿਦਿਆਰਥੀ ਅਧਿਕਾਰਾਂ ਲਈ ਪ੍ਰਦਰਸ਼ਨ ਕਰ ਰਿਹਾ ਇੱਕ ਸਕੂਲੀ ਲੜਕਾ ਸੀ, ਨਾ ਕਿ ਪੁਲਿਸ ਨੇ ਉਸ 'ਤੇ ਝੂਠਾ ਇਲਜ਼ਾਮ ਲਗਾਇਆ ਸੀ ਕਿ ਉਸ ਨੇ ਇੱਕ ਬਾਲਗ ਹੋਣ 'ਤੇ ਚਾਕੂ ਨਾਲ ਲੈਸ ਗੰਭੀਰ ਸਰੀਰਕ ਨੁਕਸਾਨ ਦੀ ਧਮਕੀ ਦਿੱਤੀ ਸੀ।

ਇਹ ਕੇਸ ਭਾਰਤ ਵਿੱਚ ਇੱਕ ਨਾਬਾਲਿਗ ਨਜ਼ਰਬੰਦ ਦੀ ਉਮਰ ਨਿਰਧਾਰਤ ਕਰਨ ਦੀ ਇੱਕ ਉਦਾਹਰਨ ਹੈ। ਜੱਜਾਂ ਨੇ ਸਥਾਪਿਤ ਕੀਤਾ ਕਿ ਦੋਸ਼ੀ ਦੇ ਹੱਕ ਵਿੱਚ ਉਮਰ ਨਿਰਧਾਰਤ ਕਰਨ ਲਈ ਵਰਤੇ ਜਾਂਦੇ ਰੇਡੀਓਲੌਜੀਕਲ ਅਤੇ ਆਰਥੋਪੀਡਿਕ ਟੈਸਟ ਦੇ ਨਤੀਜਿਆਂ ਲਈ ਨਿਆਂਇਕ ਕਾਰਵਾਈਆਂ ਵਿੱਚ ਦੋ ਸਾਲਾਂ ਦੀ ਗਲਤੀ ਲਾਗੂ ਕੀਤੀ ਜਾਵੇ।[10] ਪੂਰੇ ਭਾਰਤ ਵਿੱਚ ਨਾਬਾਲਗਾਂ ਦੀ ਰਿਹਾਈ ਨੂੰ ਸੁਰੱਖਿਅਤ ਕਰਨ ਲਈ ਕੇਸ ਤਿੰਨ ਦਹਾਕਿਆਂ ਤੋਂ ਨਿਰੰਤਰ ਜਾਰੀ ਰੱਖਿਆ ਗਿਆ ਹੈ[11], ਅਤੇ ਜੁਵੇਨਾਈਲ ਜਸਟਿਸ ਐਕਟ, 2000 ਦੇ ਕਾਨੂੰਨ ਨੂੰ ਪ੍ਰਭਾਵਤ ਕੀਤਾ।[12][13]

1983 ਜੰਮੂ ਕਸ਼ਮੀਰ ਦੀਆਂ ਆਮ ਚੋਣਾਂ[ਸੋਧੋ]

ਉਸ ਨੇ 1982 ਵਿੱਚ ਪੈਂਥਰਜ਼ ਪਾਰਟੀ ਦੀ ਸਹਿ-ਸਥਾਪਨਾ ਕੀਤੀ, ਜਿਸ ਨੇ 1983 ਵਿੱਚ ਜੰਮੂ-ਕਸ਼ਮੀਰ ਵਿਧਾਨ ਸਭਾ ਦੀਆਂ ਚੋਣਾਂ ਵਿੱਚ ਸਾਰੀਆਂ ਸੀਟਾਂ ਲੜੀਆਂ ਸਨ। ਜੈ ਮਾਲਾ ਊਧਮਪੁਰ ਹਲਕੇ ਵਿੱਚ 16 ਹੋਰ ਮਰਦਾਂ ਦੇ ਮੁਕਾਬਲੇ ਇਕਲੌਤੀ ਮਹਿਲਾ ਉਮੀਦਵਾਰ ਵਜੋਂ ਖੜੀ ਸੀ। ਉਹ 3,768 ਵੋਟਾਂ (13.75%) ਦੇ ਨਾਲ ਤੀਜੇ ਨੰਬਰ 'ਤੇ ਰਹੀ।[14]

ਉਸ ਨੇ ਆਮ ਚੋਣਾਂ ਵਿੱਚ ਸਾਰੀਆਂ ਮਹਿਲਾ ਉਮੀਦਵਾਰਾਂ ਵਿੱਚੋਂ ਦੂਜੇ ਨੰਬਰ 'ਤੇ ਸਭ ਤੋਂ ਵੱਧ ਵੋਟਾਂ ਪਾਈਆਂ।[15] ਕੁੱਲ 512 ਉਮੀਦਵਾਰਾਂ ਵਿਚੋਂ ਸਿਰਫ ਸੱਤ ਔਰਤਾਂ ਨੇ ਚੋਣ ਲੜੀ ਸੀ।

ਸੰਨ 1984 ਵਿੱਚ ਉਸ ਦੇ ਪਤੀ ਭੀਮ ਸਿੰਘ, ਇੱਕ ਚੁਣੇ ਗਏ ਵਿਰੋਧੀ ਧਿਰ ਦੇ ਮੈਂਬਰ, ਨੂੰ ਸ੍ਰੀਨਗਰ ਵਿੱਚ ਜੰਮੂ-ਕਸ਼ਮੀਰ ਵਿਧਾਨ ਸਭਾ ਵਿੱਚ 11 ਸਤੰਬਰ ਨੂੰ ਹੋਣ ਵਾਲੀ ਬਹਿਸ ਲਈ ਜੰਮੂ ਤੋਂ ਜਾਂਦੇ ਸਮੇਂ ਗੈਰ ਕਾਨੂੰਨੀ ਢੰਗ ਨਾਲ ਗ੍ਰਿਫਤਾਰ ਕਰ ਲਿਆ ਗਿਆ ਸੀ ਅਤੇ ਪੁਲਿਸ ਨੇ ਉਸ ਨੂੰ ਲੁਕਾ ਦਿੱਤਾ ਸੀ, ਜਿੱਥੇ ਉਸ ਦੀ ਵੋਟ ਅਹਿਮ ਹੋ ਸਕਦੀ ਸੀ। ਜੈ ਮਾਲਾ ਨੇ ਆਪਣੇ ਪਤੀ ਨੂੰ ਲੱਭਣ ਅਤੇ ਉਸ ਨੂੰ ਆਜ਼ਾਦ ਕਰਾਉਣ ਲਈ ਜੰਮੂ-ਕਸ਼ਮੀਰ ਦੀ ਸਰਕਾਰ ਵਿਰੁੱਧ ਉਸ ਸਮੇਂ ਦੇ ਮੁੱਖ ਮੰਤਰੀ ਗੁਲਾਮ ਮੁਹੰਮਦ ਸ਼ਾਹ ਨੂੰ ਜਵਾਬਦੇਹ ਵਜੋਂ ਕੇਸ ਦਾਇਰ ਕੀਤਾ ਸੀ।[16]

ਭੀਮ ਸਿੰਘ ਦੀ ਰਿਹਾਈ ਤੋਂ ਬਾਅਦ ਮੁਆਵਜ਼ੇ ਲਈ ਸਰਕਾਰ 'ਤੇ ਮੁਕੱਦਮਾ ਚਲਾਉਣ ਵਿੱਚ ਉਹ ਉਸ ਦੀ ਵਕੀਲ ਸੀ। 1985 ਦੇ ਇੱਕ ਮਹੱਤਵਪੂਰਣ ਫੈਸਲੇ ਵਿੱਚ ਓ. ਚਿੰਨੱਪਾ ਰੈਡੀ ਨੇ ਆਪਣੇ ਪਤੀ ਨੂੰ 50,000 ਰੁਪਏ ਨਾਲ ਸਨਮਾਨਤ ਕੀਤਾ। ਝੂਠੇ ਨਜ਼ਰਬੰਦੀ ਲਈ ਮੁਦਰਾ ਮੁਆਵਜ਼ੇ ਦੇ ਪਹਿਲੇ ਕੇਸ ਦੇ ਤੌਰ 'ਤੇ ਫ਼ੈਸਲੇ ਦੇ ਆਦੇਸ਼ ਦੇ ਨਾਲ-ਨਾਲ ਇਸ ਦੇ ਉੱਚ ਪ੍ਰੋਫਾਈਲ ਦੇ ਨਾਲ, ਇਸ ਨੇ ਭਵਿੱਖ ਵਿੱਚ ਮੁਕੱਦਮੇਬਾਜ਼ੀ 'ਚ ਭਾਰਤ ਵਿਖੇ ਤਸ਼ੱਦਦ ਦੇ ਕਾਨੂੰਨ ਨੂੰ ਪ੍ਰਭਾਵਤ ਕਰਦੇ ਹੋਏ ਇਸ ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ।[17]

ਕੇਸ ਵਿੱਚ ਜੱਜ ਰੈੱਡੀ ਨੇ ਆਪਣੇ ਪਤੀ ਦੀ ਝੂਠੀ ਕੈਦ ਦੇ ਰਾਜਨੀਤਿਕ ਸੁਭਾਅ ਬਾਰੇ ਵੀ ਇਹ ਫੈਸਲਾ ਸੁਣਾਉਂਦਿਆਂ ਕਿਹਾ ਕਿ ਦੋ ਪੁਲਿਸ ਅਧਿਕਾਰੀ ਜਿਨ੍ਹਾਂ ਨੇ "ਸ਼ਰਾਰਤੀ ਜਾਂ ਖਤਰਨਾਕ ਇਰਾਦੇ" ਨਾਲ ਕੰਮ ਕੀਤਾ ਸੀ।..."[18]

ਨਿੱਜੀ ਜੀਵਨ[ਸੋਧੋ]

ਉਸ ਦਾ ਵਿਆਹ ਪਾਰਟਨਰ ਪਾਰਟੀ ਦੇ ਨੇਤਾ ਭੀਮ ਸਿੰਘ ਨਾਲ ਹੋਇਆ ਹੈ। ਉਸ ਦਾ ਪੁੱਤਰ ਅੰਕਿਤ ਲਵ[19] ਗ੍ਰੇਟ ਬ੍ਰਿਟੇਨ ਦੀ ਵਨ ਲਵ ਪਾਰਟੀ ਦਾ ਨੇਤਾ ਹੈ।[20] ਉਸ ਨੇ ਉਸਦਾ ਨਾਮ ਪਿਆਰ ਰੱਖਿਆ, ਆਸ ਨਾਲ ਉਹ ਕਸ਼ਮੀਰ ਦੇ ਸੰਘਰਸ਼ ਵਿੱਚ ਸ਼ਾਂਤੀ ਲਿਆਵੇਗਾ। [21] [22][23]
