ਨਸਲਕੁਸ਼ੀ ਬਲਾਤਕਾਰ
ਨਸਲਕੁਸ਼ੀ ਬਲਾਤਕਾਰ ਇੱਕ ਅਜਿਹੇ ਸਮੂਹ ਦੀ ਕਾਰਵਾਈ ਹੈ ਜਿਸ ਨੇ ਨਸਲਕੁਸ਼ੀ ਮੁਹਿੰਮ ਦੇ ਹਿੱਸੇ ਵਜੋਂ ਲੜਾਈ ਦੇ ਸਮੇਂ ਦੌਰਾਨ ਜਨਤਕ ਤੌਰ 'ਤੇ ਸਮੂਹਿਕ ਬਲਾਤਕਾਰ ਦੀਆਂ ਕਾਰਵਾਈਆਂ ਕੀਤੀਆਂ ਗਈਆਂ ਹਨ।[1] ਬੰਗਲਾਦੇਸ਼ ਮੁਕਤੀ ਸੰਗਰਾਮ,[2][3][4][5] ਯੂਗੋਸਲਾਵ ਯੁੱਧ ਅਤੇ ਰਵਾਂਡਨ ਨਸਲਕੁਸ਼ੀ ਦੌਰਾਨ,[3][2] ਜਨਤਕ ਤੌਰ 'ਤੇ ਬਲਾਤਕਾਰ ਇਹੋ ਜਿਹੀਆਂ ਲੜਾਈਆਂ ਦਾ ਇੱਕ ਅਨਿੱਖੜਵਾਂ ਹਿੱਸਾ ਹੈ ਜੋ ਕੌਮਾਂਤਰੀ ਪੱਧਰ 'ਤੇ ਨਸਲਕੁਸ਼ੀ ਦੇ ਬਲਾਤਕਾਰ ਦੀ ਧਾਰਨਾ ਨੂੰ ਲਿਆਉਂਦਾ ਹੈ।[6] ਭਾਵੇਂ ਕਿ ਇਤਿਹਾਸ ਦੌਰਾਨ ਲੜਾਈ ਵਿੱਚ ਬਲਾਤਕਾਰ ਵਾਰ-ਵਾਰ ਹੁੰਦਾ ਹੈ, ਪਰ ਆਮ ਤੌਰ 'ਤੇ ਇਹ ਲੜਾਈ ਦੇ ਉਪ-ਉਤਪਾਦ ਵਜੋਂ ਸਮਝਿਆ ਜਾਂਦਾ ਹੈ, ਨਾ ਕਿ ਫੌਜੀ ਨੀਤੀ ਦਾ ਇੱਕ ਅਨਿੱਖੜਵਾਂ ਹਿੱਸਾ ਸਮਝਿਆ ਜਾਂਦਾ ਹੈ।[7]
ਭਾਰਤ ਦੀ ਵੰਡ ਦੌਰਾਨ ਔਰਤਾਂ ਵਿਰੁੱਧ ਹਿੰਸਾ ਨੂੰ ਵੀ ਨਸਲਕੁਸ਼ੀ ਬਲਾਤਕਾਰ ਦੀ ਉਦਾਹਰਨ ਵਜੋਂ ਹਵਾਲਾ ਦਿੱਤਾ ਜਾਂਦਾ ਹੈ।[8]
ਨਸਲਕੁਸ਼ੀ ਬਹਿਸ[ਸੋਧੋ]
ਕੁਝ ਵਿਦਵਾਨਾਂ ਦਾ ਕਹਿਣਾ ਹੈ ਕਿ ਨਸਲਕੁਸ਼ੀ ਦੇ ਅਪਰਾਧ ਦੀ ਰੋਕਥਾਮ ਅਤੇ ਸਜ਼ਾ 'ਤੇ ਕਨਵੈਨਸ਼ਨ ਨੂੰ ਇਹ ਦੱਸਣਾ ਚਾਹੀਦਾ ਹੈ ਕਿ ਜਨਤਕ ਬਲਾਤਕਾਰ ਇੱਕ ਨਸਲਕੁਸ਼ੀ ਅਪਰਾਧ ਹੈ।[2] ਦੂਸਰੇ ਵਿਦਵਾਨਾਂ ਦਾ ਕਹਿਣਾ ਹੈ ਕਿ ਕਨਵੈਨਸ਼ਨ ਦੇ ਬਲਾਤਕਾਰ ਨੂੰ ਪਹਿਲਾਂ ਹੀ ਸੰਮੇਲਨ ਦੇ ਆਰਟੀਕਲ 2 ਦੇ ਤਹਿਤ ਪਰਿਭਾਸ਼ਾ ਵਿੱਚ ਸ਼ਾਮਿਲ ਕੀਤਾ ਗਿਆ ਹੈ।[6][1] ਕੈਥਰੀਨ ਮੈਕਕਿਨੌਨ ਦੀ ਦਲੀਲ ਇਹ ਹੈ ਕਿ ਨਸਲਕੁਸ਼ੀ ਦੇ ਬਲਾਤਕਾਰ ਪੀੜਤਾਂ ਨੂੰ ਸਮੁੱਚੇ ਨਸਲੀ ਗਰੁੱਪ ਲਈ ਬਦਲ ਵਜੋਂ ਇਸਤੇਮਾਲ ਕੀਤਾ ਜਾਂਦਾ ਹੈ, ਜੋ ਬਲਾਤਕਾਰ ਨੂੰ ਇੱਕ ਦਲੀਲ ਵਜੋਂ ਵਰਤਿਆ ਜਾਂਦਾ ਹੈ, ਜਿਸਦੇ ਨਾਲ ਪੂਰੇ ਨਸਲੀ ਗਰੁੱਪ ਦੇ ਵਿਨਾਸ਼ ਨੂੰ ਨਿਸ਼ਾਨਾ ਬਣਾਇਆ ਜਾਂਦਾ ਹੈ।[9]
